A. Acceptance of Term

Registration and Personal Information

Please read the Terms of Use thoroughly and carefully. The terms and conditions set forth below ("Terms of Use") and the Privacy Policy (as defined below) constitute a legally-binding agreement between qproco Pvt Ltd operating from its Dhaka Corporate Office and you.

These Terms of Use contain provisions that define your limits, legal rights, and obligations with respect to your use of and participation in

The Terms of Use described below incorporate the Privacy Policy and apply to all users of the Application/Mobile App, including users who are also contributors of video content, information, private and public messages, advertisements, and other materials or services on the Product.

The Products are owned and operated by qproco Pvt Ltd. You acknowledge that the Product serves as a marketplace for the online distribution and publication of user-submitted information between Buyer, Seller and Traders, and, by using, visiting, registering for, and/or otherwise participating in this Application/Mobile Apps, ordering service through App including the Offers presented, promoted, and displayed on the Application/Mobile App, providing any Offers which request comes through Apps and/or by clicking on "I have read and agree to the terms of use," you hereby certify that:

You are either a BUYER, SELLER or TRADER,
You have the authority to enter into these Terms of Use,
You authorize the transfer of payment for Services requested through the use of the Product, and
You agree to be bound by all terms and conditions of these Terms of Use and any other documents incorporated by reference herein. If you do not so agree to the foregoing, you should not click to affirm your acceptance thereof, in which case you are prohibited from accessing or using the Application/Mobile App. If you do not agree to any of the provisions set forth in the Terms of Use, kindly discontinue viewing or participating in this Application/Mobile App immediately.

You specifically agree that by using the Product, you are at least 18 years of age and you are competent under the law to enter into a legally binding and enforceable contract.

All references to "you" or "your," as applicable, mean the person that accesses, uses, and/or participates in the Application/Mobile App in any manner.

Modifications to Terms of Use and/or Privacy Policy

Neardeals reserves the exclusive prerogative to modify, amend, or otherwise alter the Terms of Use, as well as any other documents referenced herein, to ensure compliance with legal and regulatory frameworks and for legitimate business purposes. Such alterations may occur at any time, and Neardeals shall duly publish the revised Terms of Use on the domain www.Neardeals/terms-and-condition. It is incumbent upon you to diligently review the Terms of Use for any modifications, and we strongly recommend frequent checks. Your continued use of the Product subsequent to any such amendments shall denote your consent and acceptance of the revised Terms of Use. Should you decline to abide by the current or future Terms of Use, we kindly request that you refrain from using or accessing the Product.

Privacy Policy

Neardeals has established a Privacy Policy that explains to users how their information is collected and used. To learn more, please refer to Privacy Policies.

B. Membership and Accessibility

License to Access

Neardeals hereby grants you a non-exclusive, revocable license to use the Application/Mobile App, apps, or its product as set forth in the Terms of Use; provided, however, that (i) you will not copy, distribute, or make derivative works of the Application/Mobile App, apps, or its product in any medium without Neardeals's prior written consent; (ii) you will not alter or modify any part of the Application/Mobile App, apps, or its product other than as may be reasonably necessary to use the Application/Mobile App, apps, or its product for its intended purposes; and (iii) you will otherwise act in accordance with the terms and conditions of the Terms of Use and in accordance with all applicable laws.

Membership Eligibility:

To use the Product, you must be at least 18 years old and legally capable of forming binding contracts. You confirm your age and agree that your registration information is accurate, and you will maintain its accuracy. Your use of the Application/Mobile App, apps, and services must comply with all applicable laws. Your Account may be terminated if we believe you are under 18 or not in compliance.

Account Creation:

To access certain features, create a password-protected Account by submitting your name and email. Providing additional optional information can enhance your experience. You may also use your Facebook account. In some cases, we may create an account upon your request.

Account Responsibility:

You are responsible for safeguarding your Neardeals password and any Third-Party Site Password. Notify us of any security breaches or unauthorized account use. You must not use someone else's Account without permission.

Liability:

You accept responsibility for any losses caused by unauthorized Account use. You may also be liable for Neardeals's losses or others due to such use.

Registered User:

An Account holder is referred to as a "Registered User."

Account Policies:

You agree to follow these policies:

Do not copy or distribute any part of the Application/Mobile App, Apps, or products without prior written authorization.
Do not alter the Application/Mobile App, Apps, or products beyond what's necessary for their intended purpose.
Provide accurate and up-to-date information in your Account.
Do not use automated systems to access the Application/Mobile App without written approval.
Do not collect or misuse information or content from the Application/Mobile App.
Do not overload Neardeals servers or interfere with the Product's proper functioning.
Do not recruit or solicit Service Providers or Service Users without Neardeals's permission.
Do not bypass Neardeals's security measures.
Do not collect personally identifiable data or use communication systems for commercial solicitation.

C. Member Conduct

PROHIBITIONS ON SUBMITTED CONTENT

You are not allowed to upload, post, transmit, transfer, distribute, or aid in the distribution of any content, including text, images, video, sound, data, information, or software, on any part of the Application/Mobile App, Apps, or its products. This prohibition includes:

Misrepresenting the source of your post, such as impersonating someone else or providing false biographical information for SELLERs.
Creating links to external sites that violate the Terms of Use.
Intending to harm or exploit individuals under the age of 18 ("Minors") in any way, or collecting their personally identifiable information without consent.
Invading anyone's privacy by attempting to collect or publish private information without their consent.
Posting falsehoods or misrepresentations that could harm Neardeals or any third party.
Sharing pornographic, harassing, hateful, illegal, obscene, defamatory, or discriminatory content.
Promoting criminal offenses, racism, hatred, violence, or physical harm.
Posting copyrighted or proprietary content without permission.
Promoting illegal copies of copyrighted works, such as pirated software or music.
Threatening, stalking, defaming, degrading, or intimidating individuals or groups based on various factors.
Attempting to harm another user's computer or impersonating others.
Advertising unrelated businesses, sending spam, or engaging in unsolicited advertising.
Distributing viruses or harmful technologies.
Sharing non-local or irrelevant content.
Posting identical content multiple times.
Using automated devices or programs for submissions without written consent from Neardeals.

PROHIBITIONS ON SENDING MESSAGES

You will not send messages to other users containing:

Offers to make national or international money transfers for amounts exceeding the asking price of a service, with intent to request a refund of any portion of the payment OR unsolicited advertising or marketing of a service not offered on the Product or an external Application/Mobile App.

NO DISCRIMINATION

Discriminatory Postings. Bangladesh laws prohibit any preference, limitation or discrimination based on race, color, religion, sex, national origin, age, handicap or other protected class. Neardeals will not knowingly accept any Posting which is in violation of the law. Neardeals has the right, in its sole discretion and without prior notice to you; to immediately remove any posting that discriminates or is any way in violation of any law.

PROHIBITIONS WITH RESPECT TO SERVICES

While using the Application/Mobile App, you must not:

Post inappropriate content or items in the wrong categories on the App.
Violate any laws, third-party rights, Account Policies, or the Terms of Use, as outlined above.
Fail to make payment for Product/Services unless the SELLER significantly alters the Service description, a clear typographical error occurs.
Attempt to evade or manipulate our fee structure, billing process, or fees owed to Neardeals.
Post false, inaccurate, misleading, defamatory, or libelous content, including personal information about any user.
Take actions that undermine the Feedback or ratings systems, such as exporting Feedback information from the Application/Mobile App for unrelated purposes.

FEEDBACK

As a participant in Neardeals's Application/Mobile App, apps, or products, you are obligated to exercise caution and good judgment when providing Feedback for other users. Inappropriate use of Feedback includes:

Threatening to leave negative or biased Feedback to compel additional services beyond the original agreement.
Providing Feedback that misrepresents the true quality of the service provider or service user.
Imposing conditions in an offer or request that restrict a service provider or service user from leaving Feedback.

Sanctions for inappropriate Feedback use may include:

Cancellation of your Feedback or postings.
Limitation of account privileges.
Account suspension.
Reduction of your earned status through the Feedback system.

To report inappropriate Feedback use, you can contact Neardeals via email at info@Neardeals.com.

In the event of disputes related to Feedback, Neardeals holds the authority to act as the final arbiter and may remove Feedback or take necessary actions as it deems reasonable, without incurring any liability. These prohibitions are illustrative and not exhaustive. Neardeals reserves the right to terminate account access, posts, or content editing, with or without notice, for any reason it deems appropriate or disruptive. Neardeals may also report illegal activities to law enforcement and cooperate with their investigations when required by law or at its discretion. It's important to note that Neardeals is not obliged to monitor or remove every user-submitted posting or information.

D. Rules for PRODUCT/SERVICE USERS

Service users must not: (a) commit to a Product/Service without paying; (b) engage in negotiations without genuine intent; (c) agree to purchase when not meeting provider terms or with disruptive intent; or (d) misuse any available options related to Product/Service on Neardeals.
Sanctions for rule violations: Neardeals may (a) cancel the Posting; (b) limit Account privileges; (c) suspend the Account; or (d) reduce earned status via the Feedback page.

E. Disclaimer and Warranties for PRODUCT/SERVICE USERS:

Claims within Warranty Period: Claims must be made within the relevant Product/Service warranty period; otherwise, it will be considered a new order.
Marketplace Disclaimer: Neardeals is a marketplace where Buyers/Traders connect with Product/Service Providers. Quality of Product/Service is the responsibility of Seller based on user specifications. Neardeals is not liable for Product/Service quality or non-performance.
Dispute Settlement Timeline: Neardeals aims to resolve disputes within 2 days of filing a complaint. If stakeholders do not respond within 2 days, Neardeals may resolve the dispute.
Dispute Coverage: In specific cases, Neardeals may compensate users for poor service. Compensation is limited to 10% of the order value or BDT 5000, provided as a future service coupon after investigation by Neardeals's support team.

F. Use of Submitted Content

NO CONFIDENTIALITY

Any content you authorize for searchability on the Application/Mobile App is considered non-proprietary and non-confidential. Neardeals may freely use or share such content for providing its services.
You are aware that any information provided by you in the Submitted Content towards locating a professional who ordinarily is bound to maintain confidentiality under law with his/her client (i.e., a doctor or a lawyer) is not extended to Neardeals.
Neardeals may disclose user information, including personal information, if it believes it is necessary to comply with legal requirements, protect its rights and property, enforce the agreement, or prevent illegal behavior, including fraud.

YOUR REPRESENTATIONS AND WARRANTIES

You are solely responsible for your Submitted Content and its consequences. You confirm that: (a) you own or have the necessary permissions for all intellectual property rights in your Submitted Content, allowing Neardeals to use it as intended on the Application/Mobile App; (b) you have the required consent from identifiable individuals in your Submitted Content to use their names and likenesses on the Application/Mobile App. You agree to cover any financial obligations to any party arising from your Submitted Content on the Application/Mobile App.

YOUR OWNERSHIP RIGHTS AND LICENSE TO Neardeals

You retain ownership of your Submitted Content. By submitting it to Neardeals, you grant Neardeals a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, reformat, translate, create derivative works, display, and perform your Submitted Content for Application/Mobile App-related purposes, including promotion and redistribution. You also grant users of the Application/Mobile App a non-exclusive license to access and use your Submitted Content as permitted by the Application/Mobile App's functionality and terms. This license terminates when you remove your Submitted Content from the Application/Mobile App.

You understand that technical processing and transmission of your Submitted Content may involve network transmissions and necessary adaptations.

You can remove your Submitted Content at any time, and the granted license will automatically expire.

Neardeals's DISCLAIMERS AND RIGHT TO REMOVE

Neardeals does not endorse any Submitted Content or any opinion, recommendation, or advice expressed therein. Neardeals expressly disclaims all liability associated with Submitted Content. Neardeals strictly prohibits copyright infringement and the violation of intellectual property rights on the Application/Mobile App. Neardeals will promptly remove any Data (as defined below) or Submitted Content that infringes upon another's intellectual property rights when properly notified through the "take down" notification procedure in Section J. Neardeals reserves the right to remove any Data or Submitted Content without prior notice. Neardeals may also terminate a user's access to the Application/Mobile App if they are determined to be a repeat infringer. A repeat infringer is a Application/Mobile App user who has received more than two notifications of infringing activity or has had Submitted Content removed from the Application/Mobile App more than twice. Additionally, Neardeals reserves the right, in its sole and absolute discretion, to determine whether any Data or Submitted Content complies with these Terms of Use and is appropriate, including violations related to copyright infringement, intellectual property law, pornography, obscene or defamatory material, or excessive length. Neardeals may remove such Submitted Content and/or terminate a user's access without prior notice and at its sole discretion.
When using the Application/Mobile App, you acknowledge and understand that you will encounter Submitted Content from various sources. Neardeals is not responsible for the accuracy, usefulness, safety, or intellectual property rights of such Submitted Content. You further acknowledge that you may encounter Submitted Content that is inaccurate, offensive, indecent, or objectionable. By using the Application/Mobile App, you agree to waive any legal or equitable rights or remedies you may have against Neardeals in this regard and indemnify and hold Neardeals, its owners, members, managers, operators, directors, officers, agents, affiliates, and/or licensors harmless to the fullest extent permitted by law in relation to your use of the Application/Mobile App.
You bear sole responsibility for the photos, profiles, and other content, including Submitted Content, that you publish, display, or transmit through the Application/Mobile App to other users. You understand and agree that Neardeals may, at its sole discretion and without incurring any liability, review and delete or remove any Submitted Content that violates this Agreement or is offensive, illegal, or threatens the rights, safety, or well-being of Application/Mobile App users or others.
SUGGESTIONS

If you send or transmit any communications, comments, questions, suggestions, or related materials to Neardeals, whether via letter, email, telephone, or other means (collectively, "Suggestions"), suggesting or recommending changes to the Application/Mobile App, including new features or functionality, all such Suggestions are non-confidential and non-proprietary. You hereby assign all right, title, and interest in these Suggestions to Neardeals, and Neardeals is free to use them without any attribution or compensation to you. This usage includes but is not limited to developing, manufacturing, having manufactured, licensing, marketing, and selling products and services. You understand and agree that Neardeals is not obligated to use, display, reproduce, or distribute any ideas, know-how, concepts, or techniques contained in the Suggestions. You also have no right to compel such use, display, reproduction, distribution, or seek recognition if the Suggestions are implemented.

G. Copyright Infringement Procedure

1. Neardeals respects intellectual property and expects the same from its users. Neardeals may terminate user accounts or access to the Neardeals Application/Mobile App for those who infringe upon others' intellectual property rights.If you believe your work is posted on the Neardeals Application/Mobile App in a way that constitutes copyright or trademark infringement, please email the following information to info@Neardeals:

Identification of the copyrighted or trademarked work claimed to be infringed, or, for multiple works on a single online site, a representative list of those works.
Identification of the material claimed to be infringing or to be removed, along with sufficient information for Neardeals to locate it.
A written statement confirming your good faith belief that the disputed use is unauthorized by the copyright or trademark owner, its agent, or the law.
Contact information, including an address, telephone number, and email address.
An electronic or physical signature of the authorized person acting on behalf of the allegedly infringed exclusive interest owner.
A statement, under penalty of perjury, that the information in your report is accurate, and you are the owner or authorized to act on their behalf.

Only the intellectual property rights owner can report potential infringements through Neardeals's system. If you're not the owner, please contact the intellectual property rights owner to handle such matters.

2. You acknowledge that while using the Neardeals Application/Mobile App, you may encounter content from various sources. Neardeals is not responsible for the accuracy, usefulness, safety, or intellectual property rights of such content. You agree to waive any legal or equitable rights or remedies against Neardeals related to inaccurate, offensive, indecent, or objectionable content and indemnify Neardeals regarding your use of the Application/Mobile App.

3. You are responsible for the content you publish or display on the Neardeals Application/Mobile App. Neardeals may, at its discretion, review and remove any content that violates this Agreement or poses a threat to user rights and safety.

H. Modifications or Termination of Neardeals App

Modification or Termination of Neardeals App

Neardeals reserves the right, at its sole discretion, to modify or discontinue the Neardeals mobile application (or any part thereof) temporarily or permanently, with or without notice. Neardeals shall not be liable to you or any third party for any such modification, suspension, or discontinuance of its services.

Termination by Neardeals

Neardeals may, at its sole and absolute discretion, delete, terminate, or deactivate your account, block your email or IP address, cancel the Neardeals App, or otherwise terminate your access to or participation in the use of the mobile application (or any part thereof), or remove and discard any submitted content on the Neardeals App ("Termination of Service"), immediately and without notice, for any reason, including, but not limited to, account inactivity or a violation of the Terms of Use.

Termination by You

You have the option to cancel your use of the Neardeals App and terminate the Terms of Use with or without cause at any time.

Effect of Termination

Upon the termination of your account, your rights to participate in the Neardeals App, including offering or purchasing services and receiving any associated fees or compensation, will automatically terminate. Your right to receive fees or compensation is conditional upon proper use of the Neardeals App, adherence to the Terms of Use, the continuous activation of your account, and your allowed participation in the mobile application. In the event of Termination of Service, your account will be disabled, and you may not be granted access to your account or any stored data. Some residual data may remain in the Neardeals system.

Neardeals will notify you via email if your use of the mobile application is cancelled or terminated, and such termination or cancellation will be effective immediately upon Neardeals's notice delivery unless previously terminated by Neardeals.

Upon Termination of Service, the following will occur: all licenses granted to you will immediately terminate, and you shall promptly delete all Neardeals App data and content in your possession or control. Neardeals retains the right to use data collected from your use of the Neardeals App for internal analysis and archival purposes, and related licenses you have granted to Neardeals shall remain in effect for this purpose. Neardeals is not obligated to return any submitted content to you.

You agree to indemnify and hold Neardeals, its officers, managers, members, affiliates, successors, assigns, directors, agents, service providers, suppliers, and employees harmless from any claim or demand, including reasonable attorneys' fees and court costs, made by any third party due to or arising from the Termination of Service.

I. Intellectual Property Rights

1. Neardeals owns all data and marks on the mobile app. The content on the Neardeals mobile app, including text, software, graphics, and trademarks, is owned by Neardeals. Other trademarks on the mobile app belong to their respective owners. Data on the mobile app is provided for your personal use and may not be used for any other purpose without written consent. Neardeals reserves all rights to the mobile app and its data. You must not interfere with security features or copy data for commercial purposes.

2. Neardeals's license for using data and marks.

The Neardeals mobile app contains data and marks protected by various laws, and Neardeals owns all rights to them. You are granted a limited, non-transferable license to use Neardeals's data for personal use on the app. The app may also contain data from other users or licensors, which you must not copy, modify, or distribute.

J. Fees at Neardeals

1. User Fees

Joining Neardeals, opening an account, and browsing posted services on our mobile app is free. Currently, Neardeals does not charge users for transactions conducted on the Neardeals platform between users. However, Neardeals reserves the right to introduce transaction-based fees or other charges at its discretion in the future. Any changes to this fee policy will take effect after we provide you with a 30-day notice by posting the changes in our Terms & Conditions.

If applicable, you agree to pay all fees or charges associated with your account based on Neardeals's current fee structure, charges, and billing terms. Failure to make timely payments or if we are unable to process your payment for any reason, we reserve the right to suspend or terminate your access to the mobile app and your account, thereby ending your Terms of Use agreement. You explicitly consent to Neardeals billing you for applicable fees, taxes, and other charges related to your use of our mobile app. These fees will be billed to your credit card or designated payment method at the time of purchase or registration for any fee-based service. In the event of account cancellation, there will be no refunds, and any outstanding fees may be charged to your credit card or billed to you. Neardeals reserves the right to pursue legal action if deemed necessary to recover unpaid fees.

2. Taxes

We act as an intermediary solely for the collection of rents and fees between users and service providers who enter into service agreements. Given the variations in state and local tax laws by locality, you are responsible for determining your own tax reporting requirements in consultation with tax advisors. We do not provide tax advice to hosts or guests, and Neardeals is not responsible or liable for any user's tax liability.

3. Refund Policy

Order Cancellation: If a buyer makes a payment and the order is in the "Placed" stage, and the seller has not started the order, the buyer can cancel the order. In this case, the refund will be initiated immediately to the original payment method used by the buyer.
No ‘Buyer Cancellation’ After Seller Acceptance: Once a seller accepts the order, and it is in the "In Progress" stage, buyers cannot cancel the order. Exception: If the seller decides to cancel the order, the buyer will receive an automatic refund to the original payment method.
Unpaid Orders: Unpaid orders do not qualify for refunds since no payment has been made.

4. Service Fees and Refund Exceptions:

Service fees provided by the Client to the Service Provider or Neardeals are final and non-refundable. Exceptions for refunds may be considered by the support management team in the following cases:

Client fully paid for a certain job but the job was canceled due to other issues.
Job has been served, and the customer cleared the bill, but a dispute arises within the warranty period.
Client paid in advance, but the job was served at a lower cost. In case of a refund, a Neardeals promo code will be provided to the customer for availing services.

5. Cancellation Policy for Service:

If a customer cancels any service less than two hours before the scheduled time, a cancellation charge will be applicable.

6. Reschedule Policy:

A service can't be rescheduled less than two hours before the scheduled time.A minimum service charge will be added to the original service charge if rescheduled less than 2 hours before the service schedule.

7. Buyer Requests Refund:

If a buyer wishes to request a refund, they can do so through the order page. This request will be sent to the seller, and they will have the opportunity to communicate with the buyer. The seller can make a refund payment directly on the app or through an alternative method agreed upon with the buyer.

8. Buyer Requests Refund, Seller Declines:

In case a buyer requests a refund, and the seller declines, the buyer has the option to report the issue to Neardeals support team. Our support team will review the case and mediate between the buyer and seller to reach a fair resolution.

K. Negotiation of Terms of Service; Disputes Between Registered Users

1. Neardeals IS NOT A PARTY TO ANY SERVICE CONTRACT

Neardeals is not a party to any service contract. Each registered user acknowledges and agrees that Neardeals is not involved in any agreements or contracts made between registered users using the Neardeals Application. Neardeals serves as a platform to connect service users and providers, but it does not play a role in service execution.

2. Disputes Between Registered Users

Your interactions with individuals or organizations through the Neardeals Application, such as payment and service performance, are solely your responsibility. You should exercise reasonable caution and conduct any necessary investigations before engaging in transactions with third parties. Neardeals does not guarantee the suitability of individuals you choose to interact with or the accuracy of their advice or information.

While Neardeals may conduct background checks on service providers to some extent, you understand that it may not cover all aspects of their history, including criminal records. Ultimately, you must make an informed decision regarding your interactions with others on the platform, as Neardeals only provides a meeting platform for service users and providers.

Nevertheless, since Neardeals's role is to connect service users and providers and it does not participate in the actual service execution, Neardeals is not responsible for any losses or damages resulting from such transactions. In the event of disputes, Neardeals is not obligated to intervene. You release Neardeals and its personnel from any claims, demands, or damages arising from such disputes.

L. Dispute Resolution

If a dispute arises between you and Neardeals, our goal is to resolve it neutrally and cost-effectively. We agree to resolve any legal disputes in accordance with this section or as mutually agreed in writing. Before pursuing a formal lawsuit, we encourage you to contact us via email at info@Neardeals.com or call our customer service at 16516 to seek resolution through alternative dispute resolution methods, such as mediation or arbitration.

1. GOVERNING LAW

The Terms of Use shall be governed in all respects by the laws of Bangladesh and any legal proceeding arising out of this Agreement will occur exclusively in the courts located in Dhaka, Bangladesh.

M. Advertising

Our Application, Neardeals, may display advertisements and promotions to support various aspects of the service. The appearance and presentation of these advertisements may change over time. Please note that the presence of advertisements on the Neardeals Application does not imply our endorsement of any advertised products or services. Neardeals is not responsible for any loss or damage resulting from dealings with advertisers on the Application.

N. Third-party Links, Contact Forms, and Phone Numbers

The Neardeals Application may include links, contact forms, and phone numbers to external websites and resources, which may be provided by third parties. These external resources could include social networking or blogging platforms, among others, allowing you to log in with your existing third-party account credentials. You can interact with and conduct transactions with these third-party sites in certain areas of our Application. Please be aware that Neardeals has no control over these external sites and resources, and we are not responsible for their availability or the content, advertising, products, goods, or services they offer. The presence of links to third-party sites does not constitute our endorsement of those sites or the products/services they provide. Neardeals is not responsible for any damage or loss resulting from the use or reliance on content, advertising, products, goods, or services from external websites or resources.

These third-party websites may have different privacy policies, terms and conditions, and business practices compared to Neardeals. When you are redirected to a third-party website or resource, whether through a link or contact form, it is important to understand that the terms and conditions and privacy policy of the third-party site apply. Any interactions and communications with parties other than Neardeals through our Application are solely between you and those third parties. P. FRAUDULENT PROTECTION POLICY

For a secure shopping experience, we monitor transactions for fraud. If we detect suspicious activity, Neardeals reserves the right to cancel past, pending, and future orders with no liability. We may also refuse or cancel orders due to pricing inaccuracies or service unavailability, requiring additional verifications. If your order is canceled or needs extra information, we'll contact you. Promotional vouchers used for canceled orders may not be refunded. Violation of the rules below will be considered fraudulent activity, and Neardeals may take actions such as (a) order cancellation, (b) account privilege suspension/limitation, (c) legal actions as per country's rules, and (d) company policy actions.

User Information and Account Misuse is and not limited to the following:

Providing wrong information during account creation or order placement, including but not limited to Name, Mobile Number, Address, Pic.
Misusing another customer's Phone/Email.
Using invalid email and phone numbers.
Copying, altering, modifying, or distributing any part of the Neardeals Application/Mobile App.
Using automated systems to access the Application/Mobile App without prior approval.
Transmitting more request messages than a human can reasonably produce.
Posting messages or information against the country's rules and regulations.
Refusing to pay for an order.
Not showing up or communicating during delivery.
Using a different person's identity to avail service.
Demanding unjustified or illogical refunds/solutions
Ordering the same service multiple times in a short period.

Entire Terms of Use:

The Terms of Use, along with the Privacy Policy and any other legal notices on the Mobile App, constitute the entire agreement between you and Neardeals. If a court deems any provision invalid, the remaining provisions remain in effect.
